If there is a chance that the marriage can be saved, then we encourage you to make the effort. Though divorce is common, it still impacts families, and its effects should not be underestimated. If in the end you decide to divorce anyways, at least you will know that you gave it your best effort, and it may help you transition to a new life.
I AM UNCOMFORTABLE TAKING LEGAL ACTION.
Many of our clients are hesitant to file because they are afraid that they may be losing out on something. They want to know what their rights and liabilities are. In the consultation, the attorney will go over your concerns. While you are certainly entitles to fight, our flat fee agreements apply only to those cases where the parties have worked out most matters and want the legal steps to be handled by a professional precisely because they do not want to dissolve the marriage and remain legally vulnerable on any front.
MY SPOUSE IS NOT COOPERATING.
My spouse is being difficult. Can I still do an uncontested divorce? The short answer to this is "probably yes." It is common for spouses to resist the official end of a marriage. However, your spouse's cooperation, while preferable, is not required to file for divorce. The significance of your spouse's resistance will depend on the nature of the dispute. Often difficult spouses eventually sign without having to go through the expense of litigation, especially if there are no children or assets.
WE HAVE IMMIGRATION ISSUES.
One of us petitioned for the other and got a green card (legal residency). The marriage is not working, can I still get divorced? The short answer is "yes." However, with immigration matters, timing is very important. When you schedule a consultation, be sure to have you immigration documents handy. We recommend that you make a list of important dates such as when you got married, when you filed, when you had the interview, when the residency card expires, if one of you is facing deportation. Be sure to disclose these facts.
CAN I GET CHILD SUPPORT DURING OR PRIOR TO GETTING DIVORCED?

Our house is up-side down and we cannot decide how to handle that piece of the liabilities. Can a judge decide this? Yes. Keep in mind. however, that if you are going to a judge, there are other steps in the process that fall outside of our flat fee. You will have to go to mediation first. If you cannot settle the matter in mediation, you will go before a judge who may decide that the house has to be sold and the parties will split the profit or loss. It is always better to try to settle matters first because it allows you to control the outcome a lot more than when the decision is left to a judge.
